Senator Bill Hagerty, a Republican from Tennessee, spoke plainly on July 19. The bill — which would define when a digital token is not a security — has stalled in the Senate Banking Committee. The primary obstacle? Partisan politics. Specifically, Hagerty said, some Democrats are blocking it because they do not want to hand President Trump a legislative win. This is not a policy dispute. And the calculus is clear: if the CLARITY Act passes in 2024, it risks boosting Trump’s reelection campaign. So the bill gets buried.

Think about the incentives if Trump wins. Would Republicans prioritize a crypto bill when they have a chance to overhaul tax, healthcare, and immigration? History says no. Conversely, if Democrats win, they will feel vindicated in their enforcement-first approach. They may even push for stricter rules like the Digital Asset Anti-Money Laundering Act. The CLARITY Act would become collateral damage.

So the real contrarian view: the CLARITY Act is not a short-term political football. It is a multi-cycle structural problem. It will only pass when the political cost of doing nothing exceeds the cost of giving the other side a win. That tipping point may be years away — if it ever comes.

Skepticism is the only viable alpha.

Right now, the correct position is to rotate capital toward non-U.S. regulatory frameworks. The EU’s MiCA is already live. Hong Kong’s licensing regime is active. Singapore’s Payment Services Act is proven. These jurisdictions offer the clarity that the CLARITY Act promised but could not deliver.

The tragedy is that the technical fix exists. The Howey test is decades old. The decentralization threshold can be measured with metrics like Nakamoto coefficients and node distribution. The code is ready. But the operators — the Senators, the party leaders, the political strategists — have locked it in a governance reentrancy loop. And the industry pays the gas fees.
