India's GitHub Removal Order: The Censorship Precedent That Threatens Every Open-Source Project

India's government just fired a shot across the bow of every open-source developer. The Internet Freedom Foundation (IFF) announced that the Indian government issued a removal order to GitHub for a repository linked to BitChat. The IFF called it unconstitutional.

Code is law, but vigilance is the price of entry. This isn't just a legal skirmish—it's a test case for whether code can be silenced by executive fiat. The implications ripple far beyond one chat app.


Context: The IT Act 69A and the weaponization of platform compliance

BitChat is a decentralized messaging protocol. Not a meme coin. Not a rug pull. Just a piece of open-source software that allows peer-to-peer communication without intermediaries. The Indian government claims its removal is necessary under Section 69A of the Information Technology Act, which allows blocking of content in the interest of national security, sovereignty, or public order.

But the IFF argues this order exceeds the law's scope. The repository contains only source code—not illegal content, not user data, not incitement. Code, as a form of speech, is protected under Article 19(1)(a) of India's Constitution. The government's move attempts to subvert that protection by dressing censorship in the garb of administrative action.

GitHub is now caught in the middle. If it complies, it becomes the enforcer of a potentially unconstitutional order. If it resists, it risks legal consequences in a major market. This is the same dynamic that played out with Tornado Cash sanctions—and we all saw how that ended.

What happens when other governments—say, the US, EU, or China—demand similar takedowns? The precedent set in India will be cited globally. We saw this with data localization laws. We saw it with gag orders on exchanges. Now it's coming for the code itself.


Contrarian: The real threat isn't the removal—it's the absence of resistance

Many will focus on the legal battle. Will the IFF win? Will GitHub comply? Those are important but secondary.

The primary concern is what happens if GitHub quietly removes the repository without a public fight. If that happens, the message to every developer is clear: your code is only as permanent as the next government whim.

BitChat is a canary in the coal mine. If the canary dies, the mines don't shut down—they become more dangerous. Developers will either self-censor (avoid controversial projects) or retreat to fully decentralized platforms like Radicle or secure enclaves on Arweave. But that migration won't happen overnight. In the meantime, thousands of projects remain exposed.

The counter-intuitive insight? This order may actually accelerate the adoption of decentralized code hosting. Just as Tornado Cash sanctions boosted interest in zero-knowledge proofs and privacy protocols, this GitHub removal could push developers to treat code permanence as a non-negotiable requirement.
