The stated goal is to foster innovation and reduce compliance friction. Currently, CSI sharing is highly restricted; every data point from exam reports, risk assessments, and internal models is considered sacrosanct. The proposed ‘reshape’ would relax these restrictions under certain conditions: signed confidentiality agreements, board-level approval, and minimum cybersecurity standards. On the surface, this seems like a prudential step toward efficiency. But peel back the legal jargon, and you’ll find a familiar tension: how do you enable collaboration while preserving the integrity of sensitive data? At its core, this regulatory shift is an attempt to build a permissioned data-sharing layer on top of a legacy system. Banks want to leverage external intelligence—machine learning models from FinTechs, scalability from cloud providers—without exposing their regulatory skeleton. The CSI reform is trying to replace the ‘people as gatekeepers’ model with a ‘process as gatekeepers’ model. But processes can be gamed, just like smart contracts. The difference is that code can be formally verified; legal processes cannot. A bank might follow every new rule to the letter and still have a third-party vendor leak CSI because an employee clicked a phishing link. The regulatory response will be to tighten the rules further, creating a spiral of compliance debt. Meanwhile, a blockchain-based approach could allow banks to encrypt CSI on-chain and grant access only to authorized nodes via cryptographic keys that can be revoked instantly. But let me play contrarian for a moment. Even the most elegant cryptographic solution has its Achilles’ heel: governance. Who holds the decryption keys? Who decides when to grant access? The banking world’s move to ‘reshape’ data sharing reveals a fundamental truth: data sharing is ultimately about power. The new rules are essentially a negotiation between regulators, banks, and third parties over who gets to see what. In a pure on-chain scenario, that negotiation becomes a smart contract. But smart contracts are only as good as their inputs—if the oracle that verifies CSI integrity is compromised, the whole system fails. The banking reform, for all its bureaucracy, at least keeps the human judgment element in the loop. A regulator can decide, based on context, to allow an exception. So where does this leave us? The banking reform is a tacit admission that the old data-sharing paradigm is broken. But instead of building a new infrastructure, they’re patching the old one with more legal tape. For those of us in the blockchain space, this is both a warning and an opportunity. The warning: don’t repeat the same mistake. When designing DAO governance or DeFi protocols, we must resist the urge to create off-chain data silos that are governed by opaque committees. Every piece of sensitive data should have a cryptographically verifiable sharing policy built into the protocol itself. The opportunity: regulatory bodies are signaling a need for a more flexible, auditable data-sharing framework. If we can demonstrate that zk-based selective disclosure works for bank-level compliance, we might see a regulatory sandbox for crypto-native data sharing.
